FOR THE "OVION" MOBILE APPLICATION

INTRODUCTION

This document sets forth the TERMS AND CONDITIONS OF USE (hereinafter, "TERMS") governing access to and use of the mobile application called "OVION" (hereinafter, the "Application"), developed and managed by OVION's internal staffing team (hereinafter, "OVION" or "We"). By using the Application, you expressly and unreservedly accept all the TERMS contained herein.

1. PURPOSE

The purpose of the Application is to provide a digital platform for recruitment, management, and labor tracking that connects individuals seeking employment (hereinafter, "Candidates") with organizations requiring human talent (hereinafter, "Companies"). It also supports operational users known as Supervisors and OVION internal staff such as Recruiters and Administrators.

2. ACCEPTANCE AND MODIFICATION OF TERMS

Using the Application implies express acceptance of these TERMS. OVION may modify, update, or revise these TERMS at any time, and such modifications will take effect once published in the Application. Users are responsible for periodically reviewing the TERMS.

3. USERS AND REGISTRATION

User profiles include:

  • Candidates
  • Companies
  • Supervisors
  • Recruiters (internal to OVION)
  • Administrators (internal to OVION)

Each user must register by providing truthful and updated information. OVION reserves the right to verify and validate the data provided.

4. AVAILABLE SERVICES

OVION offers:

  • Free registration for Candidates
  • Free job application submissions
  • Automated assignment to vacancies based on profiles
  • Vacancy posting and tracking for Companies
  • Employee, schedule, project, and report management
  • On-site personnel supervision
  • Secure document handling

5. PERSONAL DATA PROTECTION

OVION collects and stores personal data in accordance with applicable U.S. federal and state laws, including the California Consumer Privacy Act (CCPA), the Children's Online Privacy Protection Act (COPPA), and other relevant regulations. Technical and administrative measures are implemented to ensure the confidentiality, integrity, and availability of the data.

6. CONFIDENTIALITY

All information processed within the Application is considered confidential. Users agree not to disclose such information without prior written authorization from OVION.

7. INTELLECTUAL PROPERTY RIGHTS

All rights over the Application, its design, content, brand, logos, and features belong to OVION. Reproduction, distribution, modification, or unauthorized use is strictly prohibited.

8. LIMITATION OF LIABILITY

OVION does not guarantee that the Application will operate uninterrupted or error-free. It shall not be liable for indirect damages resulting from use of the Application. Users agree to use the Application at their own risk.

9. ACCOUNT CANCELLATION AND TERMINATION OF SERVICE

Users may deactivate their accounts at any time without penalty. OVION may cancel accounts that violate these TERMS or misuse the platform.

10. MINOR POLICY

Use of the Application is strictly limited to individuals aged 18 or older. By registering, users declare and guarantee they are at least 18 years old. OVION reserves the right to delete accounts created by minors without legal authorization.

11. USE OF COOKIES AND SIMILAR TECHNOLOGIES

The Application may use cookies, web beacons, and similar technologies to enhance user experience, analyze trends, manage the site, and gather statistical data. By using the Application, the user consents to the use of such technologies in accordance with OVION's Cookie Policy.

12. JURISDICTION AND APPLICABLE LAW

These TERMS are governed by the laws of the United States. Any disputes shall be submitted to the competent courts in the state of Delaware, unless otherwise required by applicable law.

13. DISPUTE RESOLUTION

The parties agree to attempt to amicably resolve any dispute. If this is not possible, arbitration will be pursued in accordance with the rules of the American Arbitration Association (AAA).

14. REGULATORY COMPLIANCE

OVION complies with applicable U.S. laws and regulations, including those related to labor, consumer protection, electronic commerce, and data privacy.

15. INFORMATION SECURITY POLICY

OVION applies appropriate technical and organizational controls to protect the information in the Application against loss, misuse, and unauthorized access. This includes encryption, multi-factor authentication, and continuous monitoring.

PRIVACY POLICY

  • Supervisors and Recruiters: name, contact information, assignment history.
  • Technical Information: login credentials (encrypted), session logs, navigation logs, activity logs.

3. PURPOSES OF DATA PROCESSING

Personal data is used for the following purposes:

  • To provide recruitment and job-matching services.
  • To verify user identity and manage user accounts.
  • To communicate with users regarding updates and services.
  • To generate analytics and reports for service improvement.
  • To comply with legal and regulatory obligations.

4. LEGAL BASIS FOR PROCESSING

The legal basis for data processing includes:

  • User consent.
  • Fulfillment of a contractual or pre-contractual relationship.

10. POLICY REGARDING MINORS

The Application is intended for users aged 18 or older. OVION does not knowingly collect data from individuals under 13 years of age in compliance with COPPA. If such data is detected, it will be deleted immediately.

11. POLICY UPDATES

This Privacy Policy may be updated from time to time. Users will be notified of any significant changes through the Application. Continued use of the Application after changes implies acceptance of the updated policy.

12. APPLICABLE LAW AND JURISDICTION
